Recently,the Patent Reexamination Committee of the China National Intellectual Property Administration has made a decision[584521]on the design patent(patent number:202330573732.X)of”ceramic tile(screening)”of Henan Xinluan Intelligent Technology Co.,Ltd.:declaring all patent rights invalid.The patent was suspected of plagiarizing our company’s”screening ceramic plate”appearance patent(patent number:ZL 2022 3 0057901,X).After our company applied for invalidation,it was finally supported by the examination institution.
1、Invalid declaration of core facts
Upon examination,it is determined that the patent design of Henan Xinluan Intelligent Technology Co.,Ltd.has substantial similarities with the screening ceramic sheet disclosed in our company’s prior design,as follows:
The overall shape and design of each major part of the patent designed by our company are basically the same as those of the patent previously designed by our company,and they have the same purpose and belong to the same product category.
Only the ratio of length,width,and height of our company’s patents is different,and the curvature of the rounded corners of the product is slightly different,without forming any substantial visual differences.
According to Article 23(2)of the Patent Law,the design does not have the characteristic of”obvious distinction”and is therefore invalid in accordance with the law.
